Pixmart Inc. (“Pixmart”, “we”, “us” or “our”) runs the Pixmart marketplace and related services (together, the “Services”). By creating an account, buying or downloading a product, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Services.

Pixmart is a marketplace for digital design assets – website templates, UI kits, mockups, icons, 3D illustrations and graphics – made by Pixmart and by independent creators. You can buy products one by one or join a membership plan that gives access to the whole library.

You need an account to buy and download products. You are responsible for keeping your login details safe and for everything that happens in your account. Please give us accurate information and tell us straight away if you think someone else has used your account.

Prices are shown in US dollars and may exclude sales tax or VAT, which is added at checkout where required. Payments are processed by our payment partner; we never store your full card details. Membership plans renew automatically at the end of each period until you cancel them in your account.

When you buy a product you receive a license to use it – you do not buy the product itself. What you may do with a download is set out on our License page, which forms part of these Terms.

The Pixmart name, logo, website and our own products are owned by Pixmart Inc. Products made by independent creators remain the property of those creators. Nothing in these Terms transfers ownership of any product to you.

Creators who sell on Pixmart confirm that they own, or have permission to use, everything in their products. If you believe a product infringes your rights, write to us with the details and we will review it and remove it where appropriate.

You agree not to:

• resell, share or redistribute downloaded files, on their own or in a bundle;
• share your account or membership with other people;
• copy, scrape or mirror the marketplace or its content;
• use the Services for anything unlawful or harmful.

Because digital products cannot be returned, refunds follow our Refund Policy: we fix or refund products that are faulty or not as described.

Products are provided “as is”. To the extent the law allows, Pixmart is not liable for indirect, incidental, special or consequential damages arising from your use of the Services, and our total liability is limited to the amount you paid us in the twelve months before the claim.

You can close your account at any time. We may suspend or close accounts that break these Terms. Licenses for products you bought before your account was closed stay valid, as long as you keep to their terms.

We may update these Terms from time to time. When we make important changes we will tell you by email or on the website before they take effect. If you keep using the Services after that, you accept the updated Terms.

These Terms are governed by the laws of the country or state where Pixmart Inc. is registered, without regard to its conflict-of-law rules. Any dispute will first be handled through good-faith negotiation before going to the courts of that place.
